Terms and Conditions for Environmental Design Solutions Ltd. (EDSL) Software Subscription

ACCEPTANCE OF TERMS

By purchasing a subscription for software provided by Environmental Design Solutions Ltd. (hereinafter referred to as “EDSL”), you agree to be bound by these terms and conditions. If you do not agree to these terms, please do not purchase or use our software.

SUBSCRIPTION PLANS

EDSL offers three types of subscription plans:

  1. Standalone Monthly Subscription
  2. Standalone Annual Subscription
  3. Network Annual Subscription

The above subscriptions include access to the Tas software and Ambiens 2D, and automatically renew at the end of each billing period.

SOFTWARE USAGE

Standalone Subscriptions

Standalone subscriptions are intended to be used on a single machine. While there is some facility to move the license a limited number of times, such as in the case of a user getting a new computer or a computer being lost, standalone subscriptions are not intended to be repeatedly transferred between machines.

Network Subscriptions

Network subscriptions can be used on an unlimited number of machines and with an unlimited number of users, as long as they all belong to the same company that purchased the network license. However, EDSL reserves the right to monitor usage of network subscriptions to prevent abuse. Excessive use that significantly exceeds average usage patterns may be deemed a violation of fair use, and EDSL may contact the customer to discuss changes to their subscription or take other appropriate action.

PAYMENT

Payments for subscriptions are processed automatically and handled by Stripe, a third-party payment processing platform. By providing your credit card information, you authorize EDSL to charge the subscription fee to your card on a recurring basis. All payments are non-refundable.

CANCELLATION

Customers may cancel their subscription before the renewal date by logging into their account on the EDSL website or by contacting EDSL at least one (1) business day before the renewal date. Failure to cancel before the renewal date will result in the automatic renewal of the subscription and the customer will be charged accordingly.

NO-REFUND POLICY

All purchases of subscriptions for EDSL software, including access to the Tas software and Ambiens 2D, are final and non-refundable. Once a payment has been processed, it cannot be cancelled or refunded, regardless of the usage of the software. By making a purchase, you acknowledge and agree to this no-refund policy. Please ensure that the software meets your needs before making a purchase. ACCOUNT SECURITY

Customers are responsible for maintaining the confidentiality of their account and password and for restricting access to their computer. The customer agrees to accept responsibility for all activities that occur under their account or password.

SOFTWARE USE AND RESTRICTIONS

The customer agrees to use the EDSL software in accordance with all applicable laws and regulations. The customer is not allowed to copy, modify, or distribute the software. The customer is also prohibited from reverse engineering, decompiling, or disassembling the software.

INTELLECTUAL PROPERTY

All software, content, and trademarks contained within the EDSL software are the property of EDSL and its licensors. The customer is not granted any rights or licenses to any intellectual property owned by EDSL or its licensors.

DISCLAIMERS AND LIMITATION OF LIABILITY

EDSL provides the software “as is” and without any warranties. EDSL will not be liable for any damages, including indirect, incidental, special, consequential, or punitive damages, arising from the use of the software.

CHANGES TO TERMS AND CONDITIONS

EDSL reserves the right to change these terms and conditions at any time without notice. It is the customer’s responsibility to review these terms and conditions regularly.
